IMCAs were introduced as a statutory duty in 2007 by the Mental Capacity Act 2005. They are designed to be a legal safeguard for people who lack the capacity to make specific important decisions about where they live and about serious medical treatment options. They are mainly for people who have no friends or family able to advocate for them. An IMCA may also be instructed for people making decisions concerning care reviews or adult protection. The role of the IMCA is also required for people going through the process or subject to Deprivation of liberty safeguards (DOLS).
